NEGOTIATION RIGHTS FOR INDEPENDENT COMMUNITY PHARMACIES

 

 

The Community Pharmacy Fairness Act of 2007  (H.R. 971) known as “Negotiation Rights for Community Pharmacists” was introduced by Congressman Anthony Weiner (D-NY) and Congressman Jerry Moran (R-KS) in the House of Representatives on February 8, 2007. The bill enables independent pharmacies to enter into bonafide business negotiations in order to deliver the healthcare service, access and choice that their patients deserve.

 

This bill will give community pharmacies the same leverage that much larger chains enjoy when negotiating their Medicare Part D and other third-party contracts. It simply allows community pharmacy to get a better deal for their patients by entering into business negotiations with the giant Pharmacy Benefit Managers, (PBMs).  

 

H.R. 971 specifically states:

 

“To ensure and foster continued  patient safety and quality of care by making the antitrust laws apply to negotiations between groups of independent pharmacies and health plans and insurance issuers (including health plans under parts C and D of the Medicare Program) in the same manner as such laws apply to protected activities under the National Labor Relations Act.”
